They told me that the rugs are bad, they can buy better ones at IKEA. Artists with rugs are not accepted into the Union of Artists. And if I want to make woven images, I must train as a tapestry maker and weave tapestries. I spat, decided that I was not going to weave tapestries and it was generally unclear why I decided to join there.
It seems to me that format and adherence to it is the motto of this organization. A step to the right, a step to the left - execution on the spot. This format was formed in the late seventies. It reminds me of a community of old southern aristocrats who gather for forty years in a row at some Colonel Dupont's, smoke cigars and remember the old days. On the street there is already a different era, a different century, different conditions... neither they, nor their memories, nor their cigars are of interest to anyone. And if I were them, I would pay extra to people who agree to play this with them. and they manage not to accept anyone else.
This time I took the path of conformity. For three years I exhibited with our city youth and was active. They tolerated me, despite not quite the statutory age. Therefore, I decided that as an honest person I was obliged to marry them.
This year the youth team decided to join almost in full force. They took away my works with sauce, which everyone likes, and several watercolors.


And at the appointed time I went first to the section. After all, I’m joining as a scheduler, at first the schedulers looked at us. The building is pretentious, in the center of Moscow. A long corridor is filled with a bunch of artists from different cities. By the way, there are chairs there! So people-pleasing has reached there too...


There is a list on the wall, and everyone in turn is called into the room where the commission is meeting. You arrange your works, at this time the secretary reads from your personal file where you studied and what major exhibitions you have, and you leave.


We have to wait for everyone to see it. The lady secretary (this is her moment of fame. And she has been working there for 50 years) calls everyone into a separate room. Everyone huddles in the corners as she announces the results of the commission's vote.


Today was the second day, secretariat. I met a friend from Kostroma there. The train arrives at 6 am, and she sat there in the corridor until two and waited. There were many different cities. I also wanted to go to an exhibition of photographs on a Russian estate, and during the break I went there on foot. Not long on the map. Suddenly I found myself on Maroseyka. Then I got to Red Square - and immediately turned back because time was up.
I was not accepted unanimously, eight against six. So even when I indulge in conformity, I still don’t fall completely into the format :) When I was laying out the work there, first I argued with the lady who read out that my education was a cultural institute. And last time they clung to it tightly. A real artist must have an education - Surikovsky. Well, or Stroganovsky. Even from the former Leninist pedagogue, they accept the Hoodgrafists without enthusiasm, and they may turn them away. And here, in general, there is some kind of cultural institute. I had to explain that in fact my education is a mahu, it’s pretty cool. At the end of this conversation there was a call on my phone.
My husband bought it for me the day before, angry that my phone often runs out of charge and sometimes I don’t hear calls. It is the size of a handbag and rings like the trumpet of Jericho. And now I’m arranging the work, and he’ll ring! It was the child who called to report that he had come home from school. Members of the commission, including those who were completely deaf and fell asleep, were pressed into the wall by the sound wave :)

Question 6. Does the state provide any benefits to members of the Professional Union of Artists of Russia?

Answer. In modern legal and legislative practice, instead of the word “benefits”, the term “guarantees of creative activity” is usually used. The main guarantee today is that creative activity is not entrepreneurial, because according to Art. 2 of the Civil Code of the Russian Federation, entrepreneurial activity is an activity aimed at systematically generating profit. In the case of creative activity, the motivation is completely different. This means that creative figures, including members of the Professional Union of Artists of Russia, who carry out their activities independently, not under employment contracts, have the right to sell their works without registering as individual entrepreneurs (IP).

If any tax authority still tries to require the artist to register as an individual entrepreneur, refer to the resolution of the Federal Arbitration Court of the Moscow District dated August 21, 2006 No. KG-A40/7525-06, which clearly states: “Creative activity is a special type of activity and does not apply to entrepreneurial and other economic activities.”

Answer.No, there are specialized organizations for this. The task of the Professional Union of Artists of Russia is to protect the rights of artists and other creative workers. For this purpose, the Russian Academy of Agricultural Affairs comes up with legislative initiatives, represents the interests of the artistic world in relations with the state, conducts, publishes, in which, in particular, they are given.

Question 8. I am an artist, a member of the Professional Union of Artists of Russia, and I sell my works myself. What taxes do I have to pay?

Answer.If you have not registered as an individual entrepreneur, you must pay only 13 percent personal income tax by submitting an annual declaration of your income. When filing a declaration, you can receive a professional tax deduction as a taxpayer receiving royalties or remuneration for the creation, performance or other use of works of science, literature and art (Article 221 of the Tax Code of the Russian Federation).

You can receive this deduction either in the amount of actually incurred and documented expenses for the creation of works, or according to the standard, if these expenses cannot be documented. This standard for artistic and graphic works, photographic works for printing, works of architecture and design is up to 30% of the cost of the works; for works of sculpture, monumental and decorative painting, decorative and decorative art, easel painting, theatrical and film set art and graphics, made in various techniques - up to 40%.

Question 9. If I sell my own work, am I required to give the buyer a cash receipt?

Answer.According to Art. 2 of the Federal Law of May 22, 2003 N 54-FZ “On the use of cash register equipment when making cash payments and (or) settlements using payment cards” cash register equipment may not be used by organizations or individual entrepreneurs when trading in retail markets, fairs, exhibition complexes, as well as in other areas designated for trade; during peddling trade; when the manufacturer sells folk arts and crafts products. Most of the ways artists sell their works directly or indirectly relate to these types of activities and, accordingly, do not require the use of cash register equipment.

If you sell your works without registering as an individual entrepreneur, then this law does not apply to you at all, and in any case you are not required to use cash register equipment. If the buyer asks for any document for reporting, then a cash receipt order or simply a receipt for receiving money will do.

Question 10. I heard that in Soviet times, membership in the Union of Artists of the USSR was entered in the work book, included in creative and work experience, and was taken into account when assigning a pension. What about now?

Answer.Now everything is different. According to the Federal Law of December 15, 2001 No. 167-FZ “On compulsory pension insurance in the Russian Federation,” artists and other creative figures (“authors of works receiving payments and other rewards under agreements on the alienation of the exclusive right to works of science, literature, art... other persons engaged in private practice and who are not individual entrepreneurs") are subject to compulsory pension insurance, and their work experience includes only those periods when insurance contributions were paid to the Russian Pension Fund (PFR). The concept of creative work experience in the current pension legislation is not yet available, and the fact of membership in a particular creative or professional union (or creative work without joining a union) does not affect the length of service.

Question 11. What are the current features of retirement as a “free artist”?

Answer.If an employer does not pay insurance premiums for a “free artist” (regardless of his membership in a particular union), then the artist has the right to pay them for himself by registering with the Pension Fund office at his place of residence as a self-employed individual who has voluntarily entered into legal relations under compulsory pension insurance. You do not need to register an individual entrepreneur for this.

But remember that, firstly, for self-employed individuals there is a considerable mandatory minimum annual insurance contribution, and secondly, only half of the total insurance period required for calculating a retirement pension can be formed in this way. To form the other half of the length of service, you will still have to register an individual entrepreneur or look for an official employer. Otherwise, the artist risks being left with a minimum social pension.

And don’t forget about “pension points” (this is the same as “individual pension coefficient”), these “points” depend on many factors, and they also may not be enough to receive a retirement pension.

In a word, there are a lot of subtleties in pension matters, the legislation in this area is constantly changing, so for specific clarifications and information about your experience and accumulated “points” it is better to contact the Pension Fund branch.

Question 12. Do members of the Professional Union of Artists of Russia have the right to free visits to museums and exhibition halls?

Answer.Some museums and exhibition halls provide this right to professional artists and other creative workers, others do not. The Russian Ministry of Culture has not yet issued a single regulatory document in this regard, and the Ministry of Culture has not issued a decree for private galleries. Therefore, everything here still depends on the goodwill of the specific management of a specific museum (and often even a specific ticket cashier). The same situation applies to visiting museums abroad.

Question 13. I have been accepted as a member of the Professional Union of Artists of Russia. Do I need to provide any other information in order to be included in the list?

Joining the Union is a fact of recognition by the professional community of the creative, pedagogical, methodological, organizational successes and merits of each member of the Union. Therefore, it is especially important that colleagues can familiarize themselves with the professional experience of each participant. The Union website is the only information platform in Russia that collects information about teacher-artists. Each person has a personal page with a portfolio, a gallery of children’s and original works, and a presentation article illustrating their work experience.

It is important for us that every act of participation in the life of the Union becomes for each of its members a confirmation of the level of professional experience and skill. We put not only our soul into each Union event, but also the points necessary for certification, which are confirmed by the necessary documents. The presence of a portfolio and publication of methodological experience on the all-Russian professional portal is the first degree of “initiation” that each member of the Union a priori receives (together with a membership certificate and an international pass education card, confirming professional membership in the elite caste of “teachers of art” in Europe, which has the right to free admission to museums).

The second stage is getting to know our programs and projects and participating in them (more details in the section). Participation in our competitions, seminars, exhibitions, plein airs, advanced training courses for members of the Union will ALWAYS be free; or, when involving third-party organizations, it is organized with discounts and on special conditions. This is one of the main principles of the existence of the Union.

When organizing our events, we will certainly notice those members of our community for whom it is important not only to gain points for certification and their own satisfaction. We will notice those who care about science (research in the field of art pedagogy and methodology), practice (testing art materials), organizational work (implementation of their own art projects), work of a manager (creating their own workshop or studio), evaluation activities (membership in the jury and competition commissions), work to order (performing group work with children commissioned by partner companies). Active members of our community will receive the opportunity for additional development, assistance in their endeavors, our orders and additional work as it arises. This is the third stage of “initiation,” which is simply called creative friendship.
