  4. Some activities cannot be carried out by persons with a criminal record. This is an activity related to working with minors. The ban applies to persons convicted of serious and especially serious crimes.
  5. A citizen must not be in military or government service. Combination is not permitted.

Where to submit documents?

Documents are submitted to the tax office at the place of residence. It is imperative to clarify the tax office number and address (for example, through the service of the Federal Tax Service website). In most populated areas, this function is performed by the territorial inspectorate serving the area. But in Moscow, for example, registration of all individual entrepreneurs and LLCs is carried out by one, separately allocated for these purposes, Federal Tax Service No. 46. What errors prevent you from obtaining a certificate of registration of individual entrepreneurs?

1. The reason for most failures is errors in . This official document of several pages, in which you need to provide information about yourself and your future business, is not as simple as it seems. 2. When visiting the tax office in person, do not sign the application in advance. This must be done in the presence of an inspector. Only an application sent by mail or through an authorized representative is signed in advance and notarized.

3. Carefully check the details specified in the receipt for payment of the state duty. They must correspond to the details of the tax office to which you are submitting documents. If the money went to another Federal Tax Service, they will not return it to you or transfer it to the correct addressee. Registration will be refused, and the procedure will have to be completed again. 4. When choosing OKVED codes, do not indicate the types of activities that individual entrepreneurs are prohibited from engaging in. For example, tour operator activities or the production of alcoholic beverages. Step 1. Preparation of documents for submission to the Federal Tax Service. In order to register an individual entrepreneur, you will need to prepare a small package of documents:

  1. Identification. If an individual entrepreneur is registered by a citizen of the Russian Federation, then such a document is a passport. Non-citizens of the Russian Federation and stateless persons must submit to the Federal Tax Service a copy of the residence permit and a translation of a foreign passport, certified by a notary.

If an individual entrepreneur plans to use special modes, then along with the registration documents, the entrepreneur should submit a notification about the use of the simplified tax system or UTII (or both notifications in the case of combining modes). Let us note that an entrepreneur has the right to apply special regimes only if his activities meet the necessary requirements (restrictions on income level, number of employees, residual value of fixed assets, for “imposed” - restrictions on types of activities).

Step 2. Submitting the application to the Federal Tax Service. To register an individual entrepreneur, you can submit documents in the most convenient way for you:

  • personally submit the papers to the Federal Tax Service at your place of residence;
  • send documents by mail with notification and a list of attachments;
  • fill out an electronic application on the website of the Federal Tax Service or State Services.

You can also transfer documents through a representative, having previously issued a notarized power of attorney. Having received the application f. P21001, the representative of the Federal Tax Service signs and indicates the date of acceptance of documents for registration.

Step 3. Obtaining individual entrepreneur registration documents. The Federal Tax Service authorities are given 3 working days to process documents and register individual entrepreneurs. The date of receipt of registration documents should be counted from the moment the application is accepted (+ 3 business days from the date indicated by the Federal Tax Service employee in the “Documents accepted” column). After the established period, you should contact the fiscal service to receive a Unified State Register of Entry and Entry (USRIP) entry sheet (form P60009). This document confirms your registration as an individual entrepreneur from the specified date.

What to do after receiving registration documents

After registration documents have been received, to conduct the activities of an individual entrepreneur, you should:

  • submit documents to the Federal Tax Service to select a taxation regime (STS, ENDV, PSN). If the application for the use of the special regime is not completed, the activities of the individual entrepreneur will be subject to taxes according to OSNO;
  • apply to the Federal Tax Service to register as a payer of insurance premiums and to the Federal Tax Service - as an employer (relevant for individual entrepreneurs with employees);
  • obtain a license (for individual entrepreneurs conducting licensed activities).

Features of making changes to the individual entrepreneur registration sheet

An entrepreneur may need to correct information in registration documents in the following cases:

  • change of address (place of registration and/or residence);
  • change of citizenship;
  • making changes to types of activities (change of the main type of activity, change of additional types).

Changes should be reflected in the individual entrepreneur data reflected in the Unified State Register of Individual Entrepreneurs. To do this, the entrepreneur should contact the local Federal Tax Service with documents certifying the fact of the changes (data on the new registration, documents confirming citizenship, etc.).

Within 5 working days from the date of receipt of documents certifying the changes, the Federal Tax Service makes appropriate adjustments to the Unified State Register of Individual Entrepreneurs. After this period, the entrepreneur has the right to contact the Federal Tax Service to obtain an up-to-date form f. P60009.

How to restore individual entrepreneur registration documents

Before the legislative changes came into force, if the individual entrepreneur’s registration certificate was lost, the entrepreneur had to pay a state fee and then contact the Federal Tax Service for a duplicate certificate. From 01.01.17, registration of individual entrepreneur certificates is not carried out, nor is the issuance of their duplicates. At the moment, if a certificate is lost, a citizen should contact the Federal Tax Service with a passport and an application. Within 7 working days after the application, the applicant will be issued a sheet in form p60009, indicating current information about the entrepreneur with the Unified State Register of Individual Entrepreneurs.

How to check the number of the individual entrepreneur registration certificate

Please note that individual entrepreneur registration certificates issued before 01/01/17 are considered valid. An entrepreneur does not need to additionally contact the Federal Tax Service to complete full registration and receive a form f. P60009.

In order to clarify the number of a valid individual entrepreneur certificate, you will need to use the official Internet resource on the Federal Tax Service website. The registration certificate number can be obtained if you have the entrepreneur’s TIN. If you only know the full name of the individual entrepreneur (without TIN), then you cannot check the certificate number through the Federal Tax Service website.

In the recent past, Individual Entrepreneur Registration Certificates have been cancelled. Now many citizens do not understand why, upon registration, they are not given an official document confirming the conduct of business activities. Let's look at the details of the changes.

Why was the Individual Entrepreneur Certificate cancelled, and what document is being issued instead?

The certificate of registration of individual entrepreneurs was canceled by order of the Federal Tax Service No. ММВ - 7–14/481 dated 09/12/16, which came into force on 01/01/17. What information is reflected in the USRIP Record Sheet?

The USRIP record sheet does not apply to strict reporting documents. It is issued on regular A4 paper and does not contain a holographic sticker, series or number. According to the current legislation, the basis for the activity of an entrepreneur is OGRNIP, and not the Record Sheet, therefore it is issued on a simple sheet without additional protection. However, this document has an approved form No. 60009, which is Appendix No. 2 to the Order of the Federal Tax Service.

The USRIP record sheet does not apply to strict reporting documents

The USRIP Record Sheet reflects the following information:

  • unique number - OGRNIP;
  • information about what entry was made in the Unified State Register of Individual Entrepreneurs;
  • name of the department of the Federal Tax Service;
  • Full name of the authorized person indicating the position held, as well as his signature;
  • seal of the registration authority.

Receiving a Record Sheet

The process of registering or making changes to data and/or information about an individual entrepreneur is carried out in two stages. The first is the preparation of a package of documents. The second is submitting documents to the tax office at the citizen’s place of registration.

Package of documents

Required documents include:

  • application for registration of individual entrepreneurs of an approved sample according to form No. P21001;
  • photocopy of passport;
  • a receipt confirming that state fee for individual entrepreneur registration was paid.

Optional documents include:

  • TIN. It is provided if the citizen has it or is issued as a result of the registration procedure in his absence;
  • identification card of a foreign citizen, for persons who do not have Russian citizenship;
  • identification documents for stateless persons;
  • a document confirming the place of permanent registration in the absence of registration information;
  • Birth certificate, for persons whose passport does not contain information about the place of birth;
  • notarized power of attorney for citizens registering individual entrepreneurs with the help of an intermediary;
  • a document confirming permission from the guardianship authorities for entrepreneurial activities and parental consent to conduct activities, or a court decision confirming the full legal capacity of a citizen, or a Marriage Certificate for minor citizens.

How to choose OKVED codes?

After collecting documents, the entrepreneur must select OKVED codes to confirm information about the areas of activity that the individual entrepreneur will engage in. To do this, you can use the all-Russian classifier OKVED or OKVED-2.

Important! Please note that for all forms of legal relations that arose later than 01/01/14, from 01/01/17 the OKVED-2 classifier is in effect. The OKVED classifier is used only for legal relations that arose before December 31, 2013.

The classifier consists of 21 sections, each of which has its own subsections. In the application for registration of individual entrepreneurs, you must enter a code consisting of at least four digits. For example, 47.51 is a subgroup for conducting retail trade in textile products, which includes the sale of textiles and haberdashery products 47.51.1 and 47.51.2, respectively.

The classifier has a breakdown into logical sections. For example, by selecting the “Trade” section, an entrepreneur can easily find an item that will relate to the selected type of sales.

The individual entrepreneur has the right to indicate one code or select a whole list of codes that best meet his needs. However, it should be noted that some types of activities may expand the mandatory package of documents. For example, a certificate of no criminal record for work in preschool institutions, schools, social or medical organizations.

How to fill out an application?

The application is submitted in form No. P21001, which consists of five sheets. The first sheet indicates:

  • Full name of the person registering the individual entrepreneur;
  • TIN (if available);
  • date, place of birth and citizenship.

The second sheet contains the following information:

  • citizen registration;
  • passport data;
  • residence index.

The third sheet is provided for foreigners and stateless persons. It contains the same information as on the second sheet for Russian citizens.

The fourth sheet is a place to indicate all selected OKVED codes, consisting of 4 or more digital characters.

On the fifth sheet, the applicant deciphers his full name, signs, indicates the procedure for obtaining registration documents and a contact phone number.

Important! The full name and signature must be written in black ink only in the presence of a tax official accepting the application.

Duty

The mandatory state fee for registering an individual entrepreneur is 800 rubles. regardless of the form or place of submission of documents. When filing an application to terminate a business activity, the fee is 160 rubles.

In accordance with Article 346.13 of the Tax Code of Russia, if an entrepreneur submits a corresponding application within 30 days from the date of registration of an individual entrepreneur, then the date of entry into force of the simplified taxation system will be considered the date of registration of the individual entrepreneur. Registration period

The registration period depends on the place of application. If it was submitted by a citizen in person to a tax authority office or on the Federal Tax Service website, then the registration period is 3 business days. If you submit an application on the State Services portal or through the MFC, the period increases to 5 working days.

What to do in case of loss of IP Certificate?

If an entrepreneur has already been registered, but has lost the Certificate, he can apply to the Federal Tax Service for its re-issuance. In place of the lost document, he will be given a Unified State Register of Entrepreneurs (USRIP) entry sheet, in accordance with the new form.

This service also requires payment of a state fee. Its size is 200 rubles. with the standard deadline for receiving new documents and 400 rubles. for urgent production.

Validity period of the certificate

The certificate is replaced in the following cases:

Submission of the IP certificate

A certificate of state registration of an individual entrepreneur is submitted in the following cases:

  • When a citizen independently terminates entrepreneurial activity.
  • By court decision to terminate business activities.
  • Due to the death of the owner of the IP certificate.

In case of temporary cessation of business activity as a punishment, this paper is not required to be submitted to the local tax authority. Suspension of business activities can be imposed by a court for up to 90 days. After this time, the entrepreneur can begin operating again.
